Description: | The GDLA Government Enforcement Defense Substantive Law Section is presenting a CLE that will explain how defending Qui Tam cases is not fundamentally different from defending other cases, but does require an awareness of certain unique attributes that distinguish them from other, more routine, civil cases. The panelists will discuss how an awareness of certain issues unique to Qui Tam cases can make taking such cases less daunting to practitioners, thereby opening the door for the possibility of expanding their defense practices into this area. The seminar will cover the essential elements of a Qui Tam case and point out critical differences from the “typical” federal case, including pleadings pitfalls, discovery challenges and the additional challenges of facing the government as a plaintiff. Panelists will include both lawyers well-versed in Qui Tam cases and an experienced litigator who does not focus on such cases; he’ll offer views on the practicalities of tooling up to handle a Qui Tam matter.
